Affiliate Program Terms & Conditions

1. Program Overview

The ContractCheck Affiliate Program allows participants ("Affiliates") to earn commissions by referring new customers to ContractCheck. The program is free to join and open to content creators, influencers, bloggers, and anyone with an audience interested in Canadian real estate.

  • Commission rate: 40% of the purchase price on all paid plans
  • Eligible plans: Essential ($49), Pro ($99), Crisis ($149)
  • Cookie duration: 30 days (last-click attribution)
  • Minimum payout: $50 CAD
  • Hold period: 14 days from commission creation
  • Payout method: Stripe Connect (direct to your bank account)

2. Commission Structure

Affiliates earn 40% of the purchase price when a referred customer completes a paid plan purchase:

  • Essential ($49) = $19.60 commission
  • Pro ($99) = $39.60 commission
  • Crisis ($149) = $59.60 commission

Commissions are earned when the referred buyer completes payment, not on signup. Each commission has a 14-day hold period before it becomes eligible for payout. Payouts require admin approval and a minimum balance of $50 CAD.

3. Permitted Promotion Methods

  • Social media posts on Instagram, TikTok, YouTube, Twitter/X, Facebook, LinkedIn
  • Blog posts, articles, and newsletters (with CASL-compliant consent for emails)
  • Video reviews, tutorials, and educational content
  • Podcast mentions and show notes
  • You must use your unique referral link for attribution

4. Prohibited Activities

The following are strictly prohibited and will result in immediate termination:

  • Spam, unsolicited emails, bulk messaging, or any violation of CASL
  • PPC/SEM bidding on "ContractCheck" brand terms or variations
  • Misleading claims about the product, its capabilities, or potential earnings
  • Self-referrals or creating fake accounts to earn commissions
  • Cookie stuffing, click fraud, or manipulating the referral system
  • Misrepresenting yourself as a ContractCheck employee or official representative
  • Using ContractCheck trademarks in domain names or social handles

5. Disclosure Requirements (Canadian Ad Standards)

Under Canadian Ad Standards guidelines, affiliates must clearly disclose their material connection to ContractCheck on every page, post, or video containing affiliate links. Disclosure must be:

  • Visible before the affiliate link (not hidden at the bottom)
  • Clear and unambiguous
  • In the same language as the content

Approved disclosure language:

  • #affiliate, #CommissionEarned, #ad, or #sponsored
  • "I earn a commission if you sign up through my link."
  • "Disclosure: This post contains affiliate links."

Not sufficient: Vague terms like "Ambassador", "Collab", "Partner", or "Thanks to ContractCheck" without explicit disclosure.

6. CASL Compliance

If you promote ContractCheck via email, you must comply with Canada's Anti-Spam Legislation (CASL):

  • You must have express opt-in consent from email recipients
  • Include a working unsubscribe mechanism in every email
  • Identify yourself and ContractCheck in the message
  • Include your physical mailing address
  • Pre-checked consent boxes are prohibited under CASL

ContractCheck may be held liable for affiliate email violations. Non-compliance will result in immediate termination.

7. Commission Clawback & Refunds

  • Commissions are reversed if the referred buyer receives a refund
  • Commissions are reversed if the referred buyer initiates a chargeback or payment dispute
  • If a commission was already paid out, a negative balance is applied to future commissions
  • Affiliates with a chargeback rate exceeding 5% may be suspended or terminated

8. Termination

  • Either party may terminate the affiliate relationship at any time, for any reason
  • On termination, pending commissions above the $50 minimum threshold will be paid out after the 14-day hold period
  • Commissions below the $50 threshold are forfeited on termination
  • ContractCheck may terminate affiliates who violate these terms without notice
  • To terminate, email [email protected] or delete your account

9. Liability & Indemnification

  • ContractCheck is not liable for any claims arising from affiliate promotional content
  • Affiliates indemnify ContractCheck against claims resulting from their marketing activities
  • ContractCheck may modify commission rates with 30 days written notice
  • The affiliate program may be discontinued at any time with 30 days notice
  • ContractCheck provides educational contract analysis only and is not a substitute for legal advice — affiliates must not claim otherwise

10. Privacy (PIPEDA)

By joining the affiliate program, you consent to the collection and processing of:

  • Your name, email address, and social media handles
  • Commission earnings and payout history
  • Stripe Connect financial information for payouts
  • Referral tracking data (cookies, click attribution)

This data is used for program administration, fraud prevention, and payouts. Data is retained for 3 years after the affiliate relationship ends. For full details, see our Privacy Policy.

11. Attribution & Tracking

  • Attribution model: Last-click — the affiliate whose referral link was most recently clicked before signup receives credit
  • Cookie duration: 30 days from the first click
  • If a buyer clicks multiple affiliate links, the most recent affiliate receives credit
  • Referrals are tracked via URL parameters and server-side cookies
