No Refund Policy

All purchases on ContractCheck are final and non-refundable.

Because our AI analysis begins immediately upon purchase and the results are delivered digitally and instantly, we do not offer refunds, returns, or credits under any circumstances. This includes but is not limited to:

• Dissatisfaction with the analysis results
• Purchasing the wrong plan
• Deciding not to use remaining chat messages
• Uploading the wrong document
• Change of mind after purchase
• Duplicate purchases

We strongly recommend using the free trial to evaluate our service before making any purchase. The free trial provides a complete analysis with your top 3 findings so you can assess the quality before paying.

Chargebacks & Disputes

Filing a chargeback or payment dispute with your bank or credit card company after receiving the digital service constitutes a violation of these terms. We reserve the right to:

• Immediately suspend or terminate your account
• Contest the chargeback with evidence of service delivery
• Pursue collection of the original amount plus any fees incurred
• Report the dispute to fraud prevention services

Service Description

ContractCheck is an AI-powered educational tool that analyzes real estate documents for potential red flags and issues. It is not a substitute for independent legal advice. You should always consult with a qualified real estate lawyer in your province before making decisions based on our analysis.

We do not guarantee the accuracy, completeness, or applicability of any analysis. The AI may miss issues or flag items that are not actually problematic for your specific situation.

Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, ContractCheck and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the service.

Our total liability for any claim arising out of or relating to the service shall not exceed the amount you paid to ContractCheck in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless ContractCheck, its founders, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from: (a) your use of the service; (b) any decisions made or actions taken based on the analysis provided; (c) your violation of these terms; or (d) your failure to obtain independent legal advice before acting on any information provided by the service.

Partner Program (Realtor Referral Commissions)

The ContractCheck Partner Program allows eligible real estate professionals — realtors and mortgage agents ("Partners") to earn commissions by referring new customers. By participating, Partners agree to the following terms:

Eligibility

• Partners must register with a company or brokerage email address. Personal email domains (Gmail, Hotmail, Yahoo, Outlook, etc.) are not accepted.
• Partners must maintain an active Partner Plan subscription ($199 CAD/month) to earn commissions.
• Partners must complete Stripe Connect onboarding to receive payouts.

Commission Structure

• Partners earn a one-time 40% commission on qualified referrals.
• Commissions are only earned on the referred customer's first purchase of a Pro ($99 CAD) or Crisis ($149 CAD) plan.
• Commission amounts: $39.60 CAD per Pro referral; $59.60 CAD per Crisis referral.
• No commissions are earned on Essential plan purchases, add-on purchases, plan upgrades, or subsequent purchases by the same customer.
• No commissions are earned on customers who were onboarded via the Partner's buyer delegation (courtesy review) feature.

Referral Tracking

• Referrals are tracked via the Partner's unique referral link. The referred customer must sign up using this link.
• Each customer can only be attributed to one Partner.
• Self-referrals are prohibited and will not earn commissions.

Payout Terms

• Commissions are subject to a 14-day hold period from the date of the referral's purchase before they become payable. This protects against chargebacks and disputes.
• Payouts are processed via Stripe Connect to the Partner's verified bank account.
• ContractCheck reserves the right to withhold, reverse, or deduct commissions if the underlying payment is refunded, disputed, or charged back.
• If a commission has already been paid and the underlying payment is subsequently disputed or refunded, the commission will be reversed or deducted from future payouts.

Partner Plan & Buyer Delegation

• The Partner Plan ($199 CAD/month) includes 10 contract reviews, 100 AI chat messages, and 5 contract comparisons per month. Usage limits reset on subscription renewal.
• Partners may delegate reviews to their buyers via the buyer delegation feature. Each delegated review uses one of the Partner's monthly review credits and provides the buyer with Essential-level features (1 review, 15 chat messages).
• Delegated reviews display the Partner's name and brokerage as a courtesy attribution on the analysis.
• Partners may purchase additional review packs (5 reviews for $79 CAD) when their monthly allocation is exhausted.

Subscription Cancellation

• Partners may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period.
• Upon cancellation, Partners will no longer earn commissions on new referrals.
• Pending commissions that have passed the 14-day hold period will still be paid out.
• No refunds are provided for partial billing periods.

Tax Obligations

• Partners are responsible for reporting commission income to the Canada Revenue Agency (CRA) and paying any applicable taxes.
• ContractCheck may issue T4A slips for commission payments exceeding $500 CAD in a calendar year, as required by Canadian tax law.
• Partners are responsible for providing accurate tax information during Stripe Connect onboarding.

Prohibited Conduct

• Partners must not make false, misleading, or deceptive claims about ContractCheck or its services.
• Partners must not engage in spam, unsolicited messaging, or any form of deceptive marketing to generate referrals.
• Partners must not create fake accounts, use bots, or manipulate the referral system in any way.
• ContractCheck reserves the right to terminate Partner accounts and forfeit pending commissions for violations of these terms.

Program Changes

ContractCheck reserves the right to modify commission rates, eligible plans, hold periods, or any other aspect of the Partner Program with 30 days' written notice to active Partners. Continued participation after such notice constitutes acceptance of the updated terms.

Account Termination

We reserve the right to suspend or terminate accounts that:

• Abuse the service (e.g., uploading non-real-estate documents)
• Attempt to circumvent payment or usage limits
• File fraudulent chargebacks
• Violate these terms of service

No refund will be issued for terminated accounts.

Privacy

Documents you upload are processed by AI for analysis purposes only. We do not sell or share your documents with third parties. Documents and analysis results are stored securely and associated with your account.

Acceptance

By creating an account or making a purchase on ContractCheck, you acknowledge that you have read, understood, and agree to these terms including the no-refund policy.
